Privacy Policy

Introduction

Your privacy concerns and trust are important to Chem Chem Association (CCA) and our related entities (together, "Chem Chem Association", "we", “us”, or “our”). This Privacy Policy has been prepared to help you understand what information is collected through your interactions with us on our website, and how this information is used. This Privacy Policy describes our privacy practices for data that we collect through our website (the “Website”). If you have questions about this Privacy Policy, you may contact us at info@chemchemassociation.org. To the extent permitted by applicable jurisdiction, by accessing our website, you consent to this Privacy Policy.

With respect to unrelated, third party websites, such as third party online retailers, advertisers, or unrelated sites that we may happen to link to, or web sites that link to our website, those third parties may collect personal information directly from you. The information policies and practices of these unrelated parties are not covered by this Privacy Policy. We do not control the privacy policies of third parties even if we may provide hyperlinks or other access to their web sites. We are not responsible or liable for their independent policies and practices. Please review their privacy policies and practices. It is your responsibility to review them and decide if you are satisfied with their protections.

For persons with disabilities, please email us at info@chemchemassociation.org for further guidance on Chem Chem Association’s Privacy Policy.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time, and when required by law, we will notify you of changes to this Privacy Policy. If we make any material changes and are required by law to notify you, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on our Website prior to the change becoming effective.

Personal Information That We Collect

Personal information is data that identifies an individual or relates to an identifiable individual. This includes information you provide to us, information which is collected about you automatically, and information we obtain from third parties.

We use certain tracking technologies to improve the functionality of the website and your experience when you access it.  We also keep a record of third party websites accessed when you are on our website and click on a hyperlink. However, we do not track users to subsequent sites and do not serve targeted advertising to them. We do not, therefore, respond to Do Not Track (DNT) signals. If you connect to our site using a mobile device, we may collect device information, including the device ID, model and manufacturer; the operating system; the location (to the city level), and the IP address. We use Google Analytics to track how often people gain access to or read our content. We use this information in the aggregate to understand what content our site visitors find useful or interesting, so we can produce the most valuable content to meet their needs.

How Does The Chem Chem Association Process or Use Personal Data?

We use the personal information we collect to provide you with a better Website experience, and in particular, for the following purposes:

  • To assist us in providing better information, and to help us improve our Website and services.
  • To learn more about our Website traffic patterns and other use in order to improve the functionality and features of our Website.
  • To help us operate, maintain and improve our systems, our Website, and your user experience.

Chem Chem Association does not collect any categories of personal information beyond the categories of personal information outlined above, and not for the purposes other than outlined above. If Chem Chem Association plans to collect and use personal information for any purposes beyond the ones outlined in this notice, additional consent will be obtained prior to use.

How and Why Does The Chem Chem Association Share Personal Data with Third Parties?

Chem Chem Association does not sell, rent, or share personal information to or with any third party not affiliated with, related to or owned by Chem Chem Association, except service providers who may assist us in such areas as our promotions, credit checks, data storage and order processing, as further detailed below. Chem Chem Association will never give or sell your personal information to unaffiliated third parties to be used for the purposes of sending you unsolicited commercial offers, such as spam. We do not share personal data about you with third parties except as follows:

  1. With service providers under contract who help with parts of our business operations. Our contracts require these service providers to only use your information in connection with the services they perform for us. Examples of the types of service providers we may share personal information with include (a) network infrastructure; (b) cloud storage; (c) Website management; (d) Internet (e.g., ISPs); (e) data analytics, and (f) information technology.
  2. When required by law, or if we have a good faith belief that such action is necessary to (a) identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, customers or other users of our website, or anyone else who could be harmed by such activities, or (b) respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law.
  3. Administrative, technical or marketing purposes: We will share information with third parties, business partners or related entities, subject to confidentiality agreements as appropriate, for research and analytical purposes; for administrative or technical support or other business purposes, or to analyze our data or to maintain and improve our services or your user experience. We may also share aggregated information about our customers with our advertisers and our marketing partners. We may share website usage information about visitors to our website with third party advertising companies.

We may also share personal data with third parties, other than those described above, but only when we have your consent to do so.

What Personal Data Rights Do You Have?

Depending on applicable law where you reside, you may be able to assert certain rights related to your personal information identified below. If any of the rights listed below are not provided under law for your jurisdiction, we have absolute discretion in providing you with those rights.

EU Privacy Rights

If you reside in the European Economic Area, United Kingdom, or Switzerland (collectively, “EEA Residents”), you have additional rights with respect to your personal data, which include rights under the EU’s General Data Protection Regulation (“GDPR”). EEA Residents have the right to: obtain a copy of the Personal Data (as defined in GDPR) collected; correct the Personal Data we have collected; have us erase the Personal Data collected if consent to collection of the Personal Data is withdrawn; and have Personal Data transferred. If you wish to exercise your rights related to Personal Data you may have provided through your use of our Website, you may contact us at info@chemchemassociation.org or at the mailing address listed on our Website.

You may opt out of the collection of navigation information about your visit to the Website by Google Analytics by using the Google Analytics Opt-Out feature.

How Your Information Is Kept Secure

Chem Chem Association takes commercially reasonable precautions, including physical, administrative and electronic safeguards, to protect and secure the confidentiality and integrity of your personal information. For example, we encrypt communications through our website with commercial strength encryption generally used by our industry. However, given the nature of the Internet and the fact that network security measures are not perfect, we cannot guarantee the absolute security of your information. If we are required to provide notice to you of a data security breach, the notice will be provided in electronic form.

CCA may also report any activity that CCA suspects may violate any law or regulation to regulators, law enforcement officials or other persons or entities.

Other Terms and Conditions

Additional terms and conditions may apply to specific portions or features of the Site, including contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Site or for any service offered on or through the Site, the latter terms shall control with respect to your use of that portion of the Site or the specific service.

CCA’s obligations, if any, with regard to its products and services are governed solely by the agreements pursuant to which they are provided, and nothing on this Site should be construed to alter such agreements.

You may not use anyone else’s ID, password or account at any time without the express permission and consent of the holder of that ID, password or account. CCA will not be liable for any loss or damage arising from your failure to comply with these obligations.

CCA DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. THE SITE AND ITS CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. CCA CANNOT ENSURE THAT ANY FILES OR OTHER DATA YOU DOWNLOAD FROM THE SITE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. CCA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CCA DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE SITE AND/OR ANY CCA SERVICES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SITE AND ANY LINKED SITES. YOUR SOLE REMEDY AGAINST CCA FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT. THIS LIMITATION IS A PART OF THE BARGAIN BETWEEN THE PARTIES.

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

CCA reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of, or access to, the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Indemnity

You agree to indemnify and hold CCA, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, affiliates, and related entities, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against CCA by any third party due to or arising out of or in connection with your use of the Site or related to any breach by you of any of the Terms of Use or applicable law, including those regarding intellectual property.

Limitation of Liability

Except where prohibited by law, in no event will CCA be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if CCA has been advised of the possibility of such damages.

If, notwithstanding the other provisions of these Terms of Use, CCA is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, CCA’s liability shall in no event exceed US$100.00. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

Waiver of Jury Trial

YOU HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THE SITE OR TERMS OF USE.

Violation of These Terms of Use

CCA may, in accordance with applicable law, disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) CCA’s rights or property, or the rights or property of visitors to or users of the Site. CCA reserves the right at all times to disclose any information that CCA deems necessary to comply with any applicable law, regulation, legal process or governmental request. CCA also may disclose your information when CCA determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

You acknowledge and agree that CCA may preserve any transmittal or communication by you with CCA through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or CCA determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of CCA, its employees, users of or visitors to the Site, and the public.

You agree that CCA may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to CCA, for which monetary damages would be inadequate, and you consent to CCA obtaining any injunctive or equitable relief that CCA deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies CCA may have at law or in equity.

You agree that CCA may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you, (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.

If CCA does take any legal action against you as a result of your violation of these Terms of Use, CCA will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to CCA. You agree that CCA will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

You agree to the personal jurisdiction by and venue in the state and federal courts in Harris County, Texas, and waive any objection to such jurisdiction or venue. In the event of any controversy or dispute between CCA and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

Any feedback you provide at this site shall be deemed to be non-confidential. CCA shall be free to use such information on an unrestricted basis.

Void Where Prohibited

Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are available to all persons or in all geographic locations, or appropriate or available for use outside of the intended geographic location. CCA reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic location. Any offer for any feature, product or service made on the Site is void where prohibited.

Miscellaneous

You may not use or export or re-export any Content or any copy or adaptation of such Content, or any product or service offered on the Site, in violation of any applicable laws or regulations. If any of the provisions of these Terms of Use are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these Terms of Use, so that these Terms of Use shall remain in full force and effect. These Terms of Use constitute the entire agreement between you and CCA with regard to your use of the Site, and any and all other written or oral agreements or understandings previously existing between you and CCA with respect to such use are hereby superseded and cancelled. CCA will not accept any counter-offers to these Terms of Use, and all such offers are hereby categorically rejected. CCA’s failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver by CCA of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between CCA and you or any other party be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.
